These Terms of Service ("Terms") govern access to and use of the Bookers platform available at https://wearebookers.com (the "Platform"), including our websites, mobile applications, administrative tools, messaging services, and related products (collectively, the "Services").
The Services enable users to discover and book table reservations, events, and experiences offered by hospitality venues and event organizers.
By accessing or using the Platform or Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Platform.
1. Operator of the Platform
The Platform is operated by:

2. Description of the Services
Bookers operates a digital platform that connects users with restaurants, hospitality venues, and event providers ("Venues").
Through the Platform, users may:
- search for restaurants, events, and experiences
- make or request reservations
- manage bookings
- receive booking confirmations and notifications
- subscribe to newsletters, promotions, and updates
- interact with Venues via messaging, SMS, or email notifications
Bookers also provides administrative tools and mobile applications used by Venues to manage reservations, guests, and communications.
Bookers acts solely as a technology provider and intermediary platform. Bookers does not operate restaurants or hospitality venues and does not provide the services offered by Venues.
All hospitality services are delivered by the respective Venue.
3. Eligibility
By using the Platform, you confirm that:
- you are at least 18 years old
- you have legal capacity to enter into binding agreements
- the information you provide is accurate and up to date
Bookers may suspend or terminate access to the Platform if these conditions are not met.
4. User Accounts
Certain features of the Services may require creating an account.
You agree to:
- maintain the confidentiality of your login credentials
- be responsible for all activity under your account
- notify Bookers immediately of any unauthorized use
Bookers may suspend or terminate accounts that violate these Terms or pose security risks.
5. Reservation and Booking Terms
5.1 Reservation Requests
Users may request reservations for tables, events, or experiences through the Platform.
A reservation becomes valid only once the Venue confirms the booking.
Bookers does not guarantee that a reservation request will be accepted.
5.2 Venue Responsibility
Venues are solely responsible for:
- confirming reservations
- delivering the booked services
- pricing and availability
- cancellation policies
- refunds and no-show policies
The contractual relationship for the hospitality service is formed directly between the User and the Venue.
6. Payments
Users typically do not pay Bookers directly for reservations. Venues may pay service or subscription fees to Bookers for use of the Platform.
Where payments are processed through the Platform, payment processing services may be provided by Adyen or other payment service providers.
Users agree that payment transactions may be subject to the terms and conditions of the relevant payment provider.
Bookers is not responsible for payment processing errors or disputes between Users and Venues regarding payments or refunds.
7. Cancellations and Refunds
Cancellation, modification, and refund policies are determined individually by each Venue.
Users agree to comply with the cancellation terms communicated by the Venue when making a reservation.
Bookers is not responsible for cancellation fees, refund decisions, or no-show penalties imposed by Venues.
8. Reviews and User Content
Users may submit reviews, ratings, or other content about Venues.
By submitting content, you confirm that:
- the content is accurate and not misleading
- the content does not violate applicable laws or third-party rights
By submitting reviews or content, you grant Bookers a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and publish such content in connection with the Platform.
Bookers reserves the right to remove or moderate content that is unlawful, offensive, misleading, or violates these Terms.
9. Communications
By using the Platform or making a reservation, you agree that Bookers and participating Venues may send you communications related to your bookings or account.
These communications may include:
- booking confirmations
- reservation reminders
- service notifications
- promotional emails or newsletters
- SMS notifications
Users may unsubscribe from marketing communications at any time using the unsubscribe link provided in messages.
10. Acceptable Use
You agree not to:
- misuse the Platform or attempt to disrupt its functionality
- submit false reservations or fraudulent information
- attempt to gain unauthorized access to systems or accounts
- use the Platform for unlawful purposes
Bookers may suspend or terminate accounts engaging in prohibited activities.
11. Intellectual Property
All intellectual property rights relating to the Platform, including software, trademarks, logos, designs, and content, are owned by or licensed to Bookers.
Users may not reproduce, distribute, or commercially exploit any part of the Platform without prior written permission.
12. Platform Availability
Bookers aims to maintain reliable access to the Platform but does not guarantee uninterrupted availability.
The Platform may be temporarily unavailable due to:
- maintenance or updates
- technical issues
- external service disruptions
Bookers is not liable for losses resulting from temporary service interruptions.
13. Limitation of Liability
To the maximum extent permitted by law, Bookers shall not be liable for:
- actions or omissions of Venues
- quality or availability of hospitality services
- indirect, incidental, or consequential damages
Where liability cannot be excluded under applicable law, Bookers' liability shall be limited to the amount paid to Bookers for the relevant service during the previous 12 months.
14. No-Show, Abuse and Fraudulent Reservations
Users must make reservations in good faith.
Bookers reserves the right to restrict, suspend, or terminate accounts in cases including but not limited to:
- repeated no-shows at Venues
- intentionally false or misleading reservation information
- abusive use of the reservation system
- attempts to manipulate availability or harm Venues
Bookers may also cancel reservations that are suspected to be fraudulent, automated, or made for purposes other than legitimate dining, event participation, or experience attendance.
Venues may apply their own no-show policies, including fees or reservation restrictions.
15. Indemnification
You agree to indemnify and hold harmless Bookers from claims, damages, or losses arising from:
- your use of the Platform
- violation of these Terms
- violation of rights of third parties
16. Suspension or Termination
Bookers may suspend or terminate access to the Platform if:
- these Terms are violated
- fraudulent activity is suspected
- required for legal or security reasons
Users may stop using the Platform at any time.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of Switzerland.
Any dispute arising from or related to these Terms shall be subject to the jurisdiction of the competent courts of Switzerland, unless mandatory consumer protection laws require otherwise.
For users located in the European Union, dispute resolution may also be pursued through applicable EU consumer dispute resolution mechanisms where required by law.
18. Venue Partner Agreements
Venues that use the Bookers platform may enter into separate commercial agreements with Bookers ("Venue Partner Agreements").
Where a Venue Partner Agreement exists, the terms of that agreement shall prevail over these public Terms of Service in relation to the relationship between Bookers and the Venue.
These Terms primarily govern the relationship between Bookers and users of the Platform.
19. Changes to These Terms
Bookers may modify these Terms from time to time.
Updated Terms will be published on the Platform with the revised effective date.
Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
